POLÍTICA DE DEVOLUCIONES Y REEMBOLSOS / RETURNS AND REFUNDS POLICY
1. Envío de obras originales / Shipping of Original Artworks
Todas las obras originales de Marta Pintado Studio se preparan y embalan cuidadosamente para protegerlas durante el transporte, teniendo en cuenta la especial naturaleza y delicadeza de cada pieza.
Las obras sobre lienzo y sobre papel se envían debidamente protegidas y acondicionadas para minimizar cualquier riesgo durante el transporte.
El plazo estimado de entrega se indicará en el momento de realizar la compra y puede variar en función del destino.
Una vez recibido el pedido, recomendamos comprobar el estado del paquete y de la obra a la mayor brevedad posible.
Si el paquete presenta daños visibles ocasionados durante el transporte, el cliente deberá comunicarlo lo antes posible a hola@martapintado.com, aportando fotografías del embalaje y de la obra, para que podamos gestionar la incidencia con la empresa de transporte.
All original artworks by Marta Pintado Studio are carefully prepared and packaged to protect them during transit, taking into account the particular nature and delicate characteristics of each piece.
Artworks on canvas and paper are properly protected and prepared to minimise any risk during transportation.
The estimated delivery time will be indicated at the time of purchase and may vary depending on the destination.
Once the order has been received, we recommend checking the condition of the package and artwork as soon as possible.
If the package shows visible damage caused during transport, the customer must notify hola@martapintado.com as soon as possible, providing photographs of the packaging and artwork so that we can manage the incident with the carrier.
2. Devolución de obras originales disponibles para compra / Returns of Original Artworks Available for Purchase
Las obras originales que aparecen disponibles para compra en la tienda son piezas únicas, realizadas artesanalmente y que requieren una manipulación y conservación especialmente cuidadosas.
Cuando legalmente resulte aplicable el derecho de desistimiento, el cliente podrá ejercerlo dentro del plazo legal establecido, comunicándolo previamente por escrito a:
No se aceptarán devoluciones enviadas sin comunicación previa.
La comunicación deberá indicar el número de pedido y la obra que se desea devolver.
Una vez comunicada la intención de desistir, el cliente deberá devolver la obra dentro del plazo legal correspondiente, utilizando un embalaje y sistema de protección adecuados que garanticen que la pieza llegue en las mismas condiciones en las que fue entregada.
The original artworks available for purchase in the store are unique, handcrafted pieces that require particularly careful handling and preservation.
Where the statutory right of withdrawal legally applies, the customer may exercise this right within the applicable statutory period by notifying us in writing in advance at:
Returns sent without prior notification will not be accepted.
The notification must include the order number and identify the artwork the customer wishes to return.
Once the intention to withdraw has been communicated, the customer must return the artwork within the applicable statutory period, using suitable packaging and protection to ensure that the piece arrives in the same condition in which it was delivered.
Gastos de devolución / Return Costs
Los gastos directos de devolución de la obra correrán a cargo del cliente, salvo que legalmente corresponda asumirlos a Marta Pintado Studio.
El cliente será responsable de elegir un sistema de transporte y embalaje adecuado para garantizar la integridad de la obra durante el envío de vuelta.
The direct costs of returning the artwork shall be borne by the customer, unless Marta Pintado Studio is legally required to assume them.
The customer is responsible for choosing an appropriate transport and packaging method to ensure the integrity of the artwork during its return shipment.
Estado de la obra / Condition of the Artwork
La obra deberá devolverse en perfecto estado, sin daños, manchas, roces, deformaciones, alteraciones, desperfectos ni signos de una manipulación que exceda de la necesaria para comprobar sus características y naturaleza.
En el caso de obras sobre papel, deberán conservarse en perfecto estado, sin dobleces, arrugas, marcas, humedad o cualquier otro deterioro.
En el caso de obras sobre lienzo, deberán conservarse sin daños en el lienzo, bastidor, pintura o cualquier otro elemento que forme parte de la obra.
La obra deberá devolverse correctamente protegida y, siempre que sea posible, utilizando el embalaje original o un sistema de embalaje equivalente que proporcione un nivel de protección adecuado.
Marta Pintado Studio podrá comprobar el estado de la obra una vez recibida.
Si la obra hubiera sufrido una disminución de valor como consecuencia de una manipulación que exceda de la necesaria para comprobar sus características y naturaleza, el cliente podrá ser responsable de dicha disminución de valor en los términos establecidos por la legislación aplicable.
The artwork must be returned in perfect condition, without damage, stains, scratches, deformation, alterations, defects or any signs of handling beyond what is necessary to establish its characteristics and nature.
In the case of artworks on paper, they must be returned in perfect condition, without folds, creases, marks, moisture or any other deterioration.
In the case of artworks on canvas, the canvas, stretcher, paint and any other element forming part of the artwork must remain undamaged.
The artwork must be returned properly protected and, whenever possible, using the original packaging or equivalent packaging that provides an adequate level of protection.
Marta Pintado Studio may inspect the condition of the artwork once it has been received.
If the artwork has suffered a loss in value as a result of handling beyond what is necessary to establish its characteristics and nature, the customer may be liable for such loss in value in accordance with applicable law.
Reembolso / Refund
El reembolso se realizará una vez recibida la obra y comprobado su estado, sin perjuicio de los plazos y condiciones establecidos legalmente.
Marta Pintado Studio podrá esperar a efectuar el reembolso hasta haber recibido la obra o hasta que el cliente aporte una prueba de su devolución, tomando como referencia lo que suceda primero, conforme a la legislación aplicable.
El reembolso se realizará utilizando el mismo medio de pago empleado para efectuar la compra, salvo que se haya acordado expresamente otro procedimiento.
The refund will be issued once the artwork has been received and its condition has been checked, without prejudice to the statutory time limits and conditions that apply.
Marta Pintado Studio may wait to issue the refund until the artwork has been received or until the customer provides proof that it has been returned, whichever occurs first, in accordance with applicable law.
The refund will be made using the same payment method used for the purchase, unless another procedure has been expressly agreed.
3. Obras realizadas por encargo o personalizadas / Commissioned or Customised Artworks
Las obras realizadas expresamente por encargo del cliente, conforme a sus especificaciones, medidas, colores, composición, características u otras indicaciones particulares, no admiten desistimiento ni devolución, al tratarse de obras realizadas conforme a las especificaciones del consumidor o claramente personalizadas.
Antes de comenzar una obra por encargo, se concretarán con el cliente las características principales de la pieza.
Una vez aceptado el encargo y comenzado el proceso de creación, no podrá solicitarse la cancelación o devolución de la obra por un cambio de opinión o por motivos ajenos a un defecto o falta de conformidad de la obra.
Esta exclusión no afecta a los derechos que legalmente correspondan al consumidor en caso de que la obra presente una falta de conformidad.
Artworks expressly commissioned by the customer and created according to their specifications, measurements, colours, composition, characteristics or other specific requirements are not eligible for withdrawal or return, as they are made according to the consumer's specifications or are clearly personalised.
Before work begins on a commissioned artwork, the main characteristics of the piece will be agreed with the customer.
Once the commission has been accepted and the creative process has begun, the artwork cannot be cancelled or returned due to a change of mind or for reasons unrelated to a defect or lack of conformity of the artwork.
This exclusion does not affect any statutory rights to which the consumer may be entitled if the artwork presents a lack of conformity.
4. Obras dañadas durante el transporte / Artworks Damaged During Transit
Los daños ocasionados durante el transporte no se consideran una devolución por desistimiento.
Si una obra llega dañada, el cliente deberá comunicarlo a hola@martapintado.com lo antes posible, aportando fotografías del embalaje exterior, del embalaje interior y de la obra dañada.
Es importante conservar tanto la obra como todos los elementos del embalaje hasta que la incidencia haya sido resuelta, ya que pueden ser necesarios para gestionar la reclamación con la empresa de transporte.
No se deberá enviar la obra de vuelta por iniciativa propia sin haber contactado previamente con Marta Pintado Studio y recibido las instrucciones correspondientes.
Damage caused during transport is not considered a withdrawal return.
If an artwork arrives damaged, the customer must notify hola@martapintado.com as soon as possible, providing photographs of the outer packaging, inner packaging and damaged artwork.
It is important to keep both the artwork and all packaging materials until the incident has been resolved, as they may be required to process a claim with the carrier.
The artwork must not be returned on the customer's own initiative without first contacting Marta Pintado Studio and receiving the corresponding instructions.
5. Excepciones / Exceptions
No se admitirán devoluciones de obras que hayan sido modificadas, restauradas, manipuladas, enmarcadas, montadas, recortadas o sometidas a cualquier intervención que altere su estado original, salvo cuando dicha devolución esté relacionada con una falta de conformidad legalmente acreditada.
Marta Pintado Studio se reserva el derecho de comprobar el estado de la obra antes de tramitar cualquier devolución y reembolso, siempre dentro de los límites establecidos por la legislación aplicable.
Returns will not be accepted for artworks that have been modified, restored, handled, framed, mounted, cut or subjected to any intervention that alters their original condition, except where the return is related to a legally established lack of conformity.
Marta Pintado Studio reserves the right to inspect the condition of the artwork before processing any return or refund, always within the limits established by applicable law.
